DMCA Policy

Frequency 43 respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512, we will respond expeditiously to claims of copyright infringement committed using our Platform.

Filing a DMCA Takedown Notice
If you believe content on Frequency 43 infringes your copyright, you may submit a takedown notice to our Designated Agent. To be valid under the DMCA, your notice must include:
- Identification of the copyrighted work claimed to have been infringed. If multiple works are covered by a single notification, provide a representative list.
- Identification of the infringing material and information reasonably sufficient to permit us to locate it (specific URL or content ID on freq43.com).
- Your contact information: name, mailing address, telephone number, and email address.
- A statement of good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement under penalty of perjury that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner.
- Your physical or electronic signature (or that of a person authorized to act on behalf of the copyright owner).

Warning: Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorneys' fees.
Our Response to Valid Takedown Notices
Upon receiving a valid DMCA takedown notice, we will:
- Remove or disable access to the allegedly infringing material promptly.
- Notify the user who posted the content that it has been removed and provide them with a copy of the takedown notice.
- Document the takedown as a strike against the user's account pursuant to our repeat infringer policy.
Filing a DMCA Counter-Notice
If you believe your content was removed by mistake or misidentification, you may submit a counter-notice. Your counter-notice must include:
- Identification of the material that was removed and the location where it appeared before removal (specific URL or content ID).
- A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number.
- A statement consenting to jurisdiction of the federal district court for the judicial district in which your address is located (or the Western District of Texas if outside the United States), and that you will accept service of process from the person who provided the original takedown notice or their agent.
- Your physical or electronic signature.

Counter-Notice Process
Upon receiving a valid counter-notice, we will:
- Forward the counter-notice to the original complaining party.
- Inform the complaining party that we will restore the removed material in 10 to 14 business days unless we receive notice that they have filed a court action seeking to restrain the user from engaging in infringing activity.
- Restore the material if no such court action notice is received within the 10-14 business day window.
Repeat Infringer Policy
Frequency 43 has adopted and implements a policy that provides for termination of users who are repeat infringers:
- Users who receive three (3) valid DMCA takedown notices will have their account permanently terminated.
- Terminated accounts lose all access, including subscriptions, stem credits, founding member status, and DIGR seller balances below the minimum payout threshold.
- There is no appeal or reinstatement for accounts terminated under the repeat infringer policy.
This policy is implemented pursuant to 17 U.S.C. § 512(i) and is required for DMCA safe harbor protection.
Misrepresentation Warning
Under the DMCA, any person who knowingly materially misrepresents:
- That material is infringing, or
- That material was removed by mistake or misidentification
may be subject to liability for damages, including costs and attorneys' fees incurred by the alleged infringer, the copyright owner or licensee, or the service provider.
Please ensure all claims are made in good faith and with a genuine belief in their accuracy.
